License Agreement
|
|
|
|
This License Agreement ("Agreement") is entered into by and between
|
|
tinyBigGAMES™ LLC ("Licensor") and any individual or entity ("Licensee")
|
|
that uses the SMOL-AI ("Software").
|
|
|
|
Grant of License
|
|
|
|
1. Free Use: The Software is provided free of charge for personal,
|
|
educational, and non-commercial use.
|
|
|
|
2. Closed Source: The Software is provided in binary form only. The source
|
|
code is not available for distribution, modification, or reverse
|
|
engineering.
|
|
|
|
3. Distribution: Licensee may not distribute, sublicense, or sell the Software
|
|
or any of its components.
|
|
|
|
4. Commercial Products: Licensee may use products created with the Software
|
|
for commercial purposes, but the SMOL-AI itself may not be
|
|
used, modified, or distributed commercially.
|
|
|
|
Restrictions
|
|
|
|
1. No Modification: Licensee may not modify, adapt, decompile, disassemble,
|
|
or reverse engineer the Software.
|
|
|
|
2. No Redistribution: Licensee may not distribute copies of the Software to
|
|
third parties.
|
|
|
|
Intellectual Property
|
|
|
|
1. Ownership: The Software, including all intellectual property rights
|
|
therein, is and shall remain the property of the Licensor.
|
|
|
|
2. Trademark: "SMOL-AI" is a trademark of the Licensor.
|
|
Licensee is not granted any rights to use the trademark without
|
|
prior written consent from the Licensor.
|
|
|
|
Disclaimer of Warranty
|
|
|
|
1. No Warranty: The Software is provided "as is" without warranty of any
|
|
kind, express or implied, including but not limited to the warranties of
|
|
merchantability, fitness for a particular purpose, and non-infringement.
|
|
|
|
2. Limitation of Liability: In no event shall the Licensor be liable for any
|
|
claim, damages, or other liability, whether in an action of contract,
|
|
tort, or otherwise, arising from, out of, or in connection with the
|
|
Software or the use or other dealings in the Software.
|
|
|
|
THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS
|
|
"AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED
|
|
TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
|
|
PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE COPYRIGHT HOLDER OR
|
|
CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL,
|
|
EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO,
|
|
PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES

PROFITS

LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING

NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS

SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Termination
|
|
|
|
1. Termination: This Agreement is effective until terminated. Licensee's
|
|
rights under this Agreement will terminate automatically without
|
|
notice if Licensee fails to comply with any term(s) of this Agreement.
|
|
|
|
2. Effect of Termination**: Upon termination, Licensee shall cease all use of
|
|
the Software and destroy all copies, full or partial, of the Software.
|
|
|
|
General
|
|
|
|
1. Governing Law: This Agreement shall be governed by and construed in
|
|
accordance with the laws of Broward County, FL.
|
|
|
|
2. Severability: If any provision of this Agreement is found to be
|
|
unenforceable or invalid, that provision will be limited or eliminated to
|
|
the minimum extent necessary so that this Agreement will otherwise remain
|
|
in full force and effect.
|
|
|
|
3. Entire Agreement: This Agreement constitutes the entire agreement between
|
|
the parties with respect to the use of the Software and supersedes all
|
|
prior or contemporaneous understandings regarding such subject matter.
|
|
|
|
By using the SMOL-AI, you acknowledge that you have read this Agreement,
|
|
understand it, and agree to be bound by its terms and conditions.
